This website is operated by Gavimoro. Throughout these terms, the words "we", "us" and "our" refer to Gavimoro. Gavimoro is operated by Princen Textiel V.O.F., registered with the Dutch Chamber of Commerce (KvK) under number 89557719, with its business address at Berghemseweg 14 G, 5348 CJ Oss, the Netherlands.
We offer this website, including all information, tools and services available on it, to you as the user, on the condition that you accept all of the terms, conditions, policies and notices set out here.
By visiting our site or purchasing something from us, you use our "Service" and agree to be bound by these Terms of Service ("Terms"), including any additional terms and policies referred to here or available by link. These Terms apply to all users of the site, including browsers, customers, and anyone who contributes content.

You must not transmit any viruses, worms or code of a destructive nature.
A breach of any of these Terms will result in the immediate termination of your access to our Services.

We reserve the right to refuse service to anyone for any reason at any time, as far as permitted by law.
You understand that your content (not including payment card information) may be transferred unencrypted and may involve transmission over various networks and changes needed to meet the technical requirements of connected networks or devices. Payment card information is always encrypted during transfer.
You agree not to reproduce, copy, sell, resell or exploit any part of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without our express written permission.
The headings in these Terms are for convenience only and do not limit or otherwise affect these Terms.

SECTION 4: CHANGES TO THE SERVICE AND PRICES
All prices on our website are shown in euros (EUR) and include VAT.
Prices for our products may change without notice. The price that applies to your order is the price shown at the moment you place it.
We reserve the right to change or discontinue the Service, or any part or content of it, at any time without notice. We will not be liable to you or to any third party for any change in price, suspension or discontinuation of the Service.
SECTION 5: PRODUCTS
Our dresses are available exclusively online through our website and may be available in limited quantities. Once a style or size is sold out, we cannot always guarantee that it will be restocked.
We have made every effort to show the colours and details of our dresses as accurately as possible. However, the way colours appear depends on your screen, so we cannot guarantee that your display will show every shade exactly as it looks in real life. Small differences in colour or texture between the photos and the actual garment are normal and are not considered a defect.
Our size guide is there to help you choose the right fit. Measurements may vary slightly between styles, so we recommend checking the size information on each product page before ordering. If you are unsure, feel free to contact us and we will gladly help.
We reserve the right to limit the sale of our products to any person or household. We also reserve the right to limit the quantities of any product we offer.
All product descriptions and pricing may change at any time without notice. We reserve the right to discontinue any product at any time.
SECTION 6: ORDERS AND PAYMENT
When you place an order, you will receive a confirmation email. A binding agreement is formed once we have sent this confirmation.
We reserve the right to refuse or cancel any order. We may limit or cancel quantities purchased per person, per household or per order. This includes orders placed by or under the same customer account, the same payment method, and orders that use the same billing or shipping address. If we change or cancel an order, we will contact you using the email address or phone number you provided when ordering, and any amount already paid will be refunded in full.
You agree to provide current, complete and accurate purchase and account information for all purchases made in our store. You also agree to promptly update your account and other details, including your email address and payment details, so that we can complete your transactions and contact you when needed.
Payment is made at the time of ordering using one of the payment methods shown at checkout.
SECTION 7: SHIPPING AND DELIVERY
We currently ship to addresses in the Netherlands only. We are unable to accept orders for delivery outside the Netherlands.
Our orders are dispatched from our warehouses in Germany or France. The warehouse your order ships from depends on the availability of the items you have ordered.
We offer two shipping options:
Free Shipping: free of charge, with delivery within 4 to 5 business days.
Insured Express Shipping: EUR 4.95, with delivery within 2 to 3 business days. This option includes insurance against loss or damage during transport.
Delivery times are estimates and start from the moment your order has been dispatched. Business days are Monday to Friday, excluding public holidays. Although we do our best to deliver on time, delays can sometimes occur because of carrier issues, high order volumes or circumstances outside our control.
Please make sure your delivery address is complete and correct. We are not responsible for delays or failed deliveries caused by an incorrect or incomplete address provided by you.
The risk of loss of or damage to your order passes to you once the parcel has been delivered to you or to a person you have designated.
SECTION 8: RIGHT OF WITHDRAWAL AND RETURNS
As a consumer, you have the right to cancel your purchase within 14 days without giving a reason. This period starts on the day after you, or someone you have designated, receive the order.
To use your right of withdrawal, please let us know by email at support@gavimoro.com within this period. After informing us, you have 14 days to return the items.
Returned dresses must be unworn, unwashed, undamaged and returned with their original labels attached. You may handle and try on the dress as you would in a shop, but if the item shows signs of use beyond this, we may deduct the loss in value from your refund.
We will refund the amount paid, including the original standard shipping costs, within 14 days of receiving your withdrawal notice. We may wait to issue the refund until we have received the returned items or until you have shown proof that you have sent them back, whichever comes first. The refund will be made using the same payment method you used for the original purchase.
If you chose Insured Express Shipping, we will refund only the cost of standard shipping, as the extra charge for express delivery was your own choice. The costs of returning the items are for your own account, unless we have agreed otherwise.
If your dress arrives damaged or you have received the wrong item, please contact us within a reasonable time after delivery and we will make it right.
SECTION 9: OPTIONAL TOOLS
We may give you access to third party tools which we do not monitor and over which we have no control.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties or conditions of any kind. We accept no liability for your use of optional third party tools.
Any use of these tools is entirely at your own risk and discretion, and you should make sure you are familiar with and approve of the terms on which the relevant third party provides them.
We may also offer new services or features through the website in the future. These will also be subject to these Terms.

Some content, products and services available through our Service may include material from third parties.
Links to third party websites may direct you to sites that are not connected to us. We are not responsible for checking or evaluating their content or accuracy, and we do not guarantee or accept any responsibility for third party materials, websites, products or services.
We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content or any other transactions made in connection with third party websites. Please review the policies and practices of any third party carefully before making a transaction.

You also agree that your comments will not contain unlawful, abusive or obscene material, or any computer virus or other malware. We may, but have no obligation to, monitor, edit or remove content that we find unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that violates anyone's intellectual property or these Terms.

Your submission of personal information through the store is governed by our Privacy Policy. We handle your personal data in line with the General Data Protection Regulation (GDPR).
SECTION 13: ERRORS AND OMISSIONS
Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, delivery times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice, including after you have submitted your order. If we cancel an order for this reason, you will receive a full refund.

In addition to other restrictions in these Terms, you may not use the site or its content: for any unlawful purpose; to ask others to take part in any unlawful acts; to violate any international, national or local regulations, rules or laws; to infringe on or violate our intellectual property rights or those of others; to harass, abuse, insult, harm, defame, slander, intimidate or discriminate against anyone; to submit false or misleading information; to upload or transmit viruses or any other malicious code; to collect or track the personal information of others; to spam, phish, pharm, pretext, spider, crawl or scrape; for any obscene or immoral purpose; or to interfere with or get around the security features of the Service or any related website.
We reserve the right to end your use of the Service or any related website for violating any of these prohibited uses.

We do not guarantee that your use of our Service will be uninterrupted, timely, secure or error free.

Nothing in these Terms limits your rights as a consumer under Dutch and European law. Every product you buy from us comes with the legal guarantee of conformity, which means it must meet the expectations you may reasonably have of it.
As far as permitted by law, Gavimoro, its partners and employees are not liable for any indirect or consequential loss or damage arising from your use of the Service or any products purchased through it. Our total liability for any order is limited to the amount you paid for that order. This limitation does not apply in cases of intent or gross negligence on our part.
SECTION 16: INDEMNIFICATION
You agree to indemnify and hold harmless Gavimoro and its partners and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or the documents they refer to, or your violation of any law or the rights of a third party.
SECTION 17: SEVERABILITY
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will still be enforced to the fullest extent permitted by law, and the unenforceable part will be treated as separate from these Terms. This will not affect the validity and enforceability of the remaining provisions.
SECTION 18: TERMINATION
The obligations and liabilities of the parties incurred before the termination date will survive the termination of this agreement.
These Terms remain in effect unless and until terminated by you or us. You may end these Terms at any time by telling us that you no longer wish to use our Services, or when you stop using our site.
If we believe you have failed to comply with any term of these Terms, we may end this agreement at any time without notice, and you will remain liable for all amounts due up to the date of termination.
SECTION 19: ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms does not mean we waive that right or provision.
